Terms of Use
Effective date: 2025-09-23
Welcome to Convoke ("we", "us", "our"). By accessing or using convoke.gg, our apps, or related services (collectively, the "Service"), you agree to these Terms of Use (the "Terms"). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
1) Eligibility & Accounts
- You must be at least 13 years old (or the age of digital consent in your region) to use the Service. In Quebec, users under 14 generally require a parent or guardian to consent.
 - You are responsible for your account credentials and all activity under your account. Keep your login information secure.
 - Provide accurate information and promptly update changes.

2) Community & Acceptable Use
We want welcoming, inclusive tables. By using the Service, you agree that you will not:
- Harass, threaten, or discriminate; engage in hate speech or targeted abuse.
 - Post illegal content, infringe IP rights, or share others' personal information without consent.
 - Cheat, defraud, spam, or manipulate ratings/recognition; interfere with gameplay, rooms, or servers.
 - Bypass fees, metering, or rate limits; attempt to scrape, reverse engineer, or attack the Service.
 - Use bots or automation without our written permission.

We may warn, mute, remove content, suspend, or terminate accounts or rooms for violations. Serious violations may be reported to authorities. We may moderate, filter, and remove content to protect users and the Service.
3) User Content & License
- You retain ownership of content you submit (e.g., chat, images, room names, decklists).
 - You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and otherwise use your content as necessary to operate, protect, and improve the Service (including moderation and abuse prevention).
 - You represent that you have all necessary rights to the content you upload.

4) AI Features, Billing & Refunds
The core platform is free to play. Some features—such as card recognition—are paid and usage-based to cover compute costs.
- Prices and quotas are shown in-app before purchase and may change prospectively.
 - Charges are processed by our payment provider; taxes may apply. We store minimal payment metadata.
 - Except where required by law, used/consumed AI credits or usage are non-refundable. Where applicable consumer laws mandate a refund or cooling-off period, we will comply; contact us to request a review.
 - We may issue promotional credits at our discretion; such credits may expire.

5) Model & Service Limitations
- AI outputs may be inaccurate or incomplete; always verify important information.
 - The Service and any information provided are for general gameplay and convenience only and do not constitute professional advice.

6) Software, Changes & Availability
- We may add, change, or remove features to improve reliability, safety, or user experience.
 - The Service may experience downtime for maintenance or due to network/provider issues.

7) Intellectual Property
All trademarks, logos, and brand names are the property of their respective owners. Convoke is not affiliated with Wizards of the Coast. Card names, images, and related IP belong to their owners and may be used under fair dealing/fair use or applicable licenses. Users are responsible for rights to any content they stream or upload.
8) Third-Party Services
We integrate with third-party services (e.g., analytics, Discord, payments). Your use of those services is governed by their own terms and privacy policies.
9) Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and share information.
10) Cookies & Tracking
We use cookies and similar technologies to operate and improve the Service (e.g., authentication, analytics). You can control cookies via your browser settings. Where required (e.g., EU/UK), we obtain consent for non-essential cookies. See the Privacy Policy for details.
11) Children’s Use
The Service is not directed to children under 13 (or under 14 in Quebec). We do not knowingly collect data from such children. If you believe a child provided us personal data, contact us so we can take appropriate steps.
12) Security
We implement reasonable technical and organizational measures to protect personal data. However, no method of transmission or storage is fully secure.
13) DMCA & Copyright
We respect intellectual property rights. To submit a copyright notice or counter-notice, email viviann.k.c@gmail.com with all information required by applicable law (including the U.S. DMCA where applicable).

Provide: your contact, identification of the work and the allegedly infringing material, the URL(s), a good-faith statement, a statement under penalty of perjury, and your signature. If your content was removed in error, you may submit a counter-notice.
We maintain a repeat infringer policy and may terminate accounts of repeat infringers in appropriate circumstances.
14) Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Convoke AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
16) Indemnification
You agree to indemnify and hold Convoke harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
17) Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms, to protect users or the Service, or as required by law. You may stop using the Service at any time.
18) Governing Law, Consumers & Disputes
These Terms are governed by the laws of Quebec, Canada, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the courts located in Quebec, Canada, unless mandatory consumer law provides otherwise. If you are a consumer resident in a jurisdiction with mandatory consumer protection laws (e.g., Quebec), those laws apply and prevail over any conflicting choice-of-law or venue terms in these Terms.
19) Export Controls & Sanctions
You agree not to use the Service in violation of applicable export control or sanctions laws and not to provide the Service to persons or regions restricted by such laws.
20) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., by email or in-app). The updated Terms will be effective when posted unless otherwise stated.
